Contractual basis
This is a convenience translation for information purposes. Only the German version of these Terms and Conditions is legally binding.
Version of 23 October 2026. The version applicable is the one available on this page at the time of your order. For orders placed before this date, the version in force at that time continues to apply.
Hereinafter “we”. The contracting party is the ordering business, hereinafter “you”.
Our offering is directed exclusively at entrepreneurs within the meaning of § 1 of the Austrian Commercial Code (UGB). By placing an order, you confirm that you are acting in the exercise of your commercial or professional activity. No contract is concluded with consumers. The provisions of the Austrian Distance and Off Premises Contracts Act on the right of withdrawal therefore do not apply.
We deliver a signal list: a compilation of German companies or of the people in their management and representation who carry the characteristics of a theme chosen by you, within the selection and in the volume chosen by you. Delivery is made as an Excel workbook by email to the address given in the order.
Each entry contains, where available:
If you choose a volume smaller than the number of matches, you receive the leading entries in the order provided for by the respective theme.
The list contains no credit rating, no revenue figures and no assurance that a listed company has a particular need, is willing to sell or will respond to an approach. A signal describes a discernible situation; it is a reasoned assessment and makes no factual assertion about the intentions of the company or its management.
The presentation on this site is an invitation to order. By submitting the order form, you make a binding offer. We accept it by sending you the invoice.
The prices in euros shown during the ordering process apply. You receive the invoice electronically as a PDF immediately after ordering; you consent to electronic invoicing under § 11 (2) of the Austrian VAT Act (UStG). The invoice amount is to be settled by bank transfer to the account stated on the invoice and is due within fourteen days.
Under § 3a (6) UStG, the place of supply is the registered office of the recipient. For recipients outside Austria we therefore charge no Austrian VAT. Tax liability is governed by the law of your country of establishment; reporting and payment are your responsibility.
We deliver the list by email once payment has been received. The list reflects the state of our database on the day it is compiled. A second sheet of the workbook states theme, selection and date of compilation. There is no entitlement to later updates.
The information on the companies is based on publicly accessible official publications and publicly accessible information provided by the companies themselves. We reproduce it as published there. We accept no responsibility for its substantive accuracy, as we do not collect it ourselves.
The assignment to industries, the supply relationships and the detection of signals are our service. They are based on a systematic evaluation and constitute reasoned assessments. A single incorrect assignment does not constitute a defect of the service as a whole.
We warrant that the delivered list reaches the volume ordered and corresponds to the selection chosen. If a substantial part of the list proves unusable, we replace the entries concerned; if this is not possible, we refund the corresponding share of the fee.
We give no assurance of commercial success. A signal list is a basis for your work. Whether a company responds, negotiates or places an order depends on your offering and your approach.
We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of slight negligence, we are liable only for the breach of essential contractual obligations, limited in amount to the foreseeable damage typical for the contract, and at most to the fee paid for the order concerned. Liability for loss of profit and for indirect damage is excluded in the case of slight negligence.
You receive a simple, perpetual, non transferable right to use the list for your own business activity. This includes importing it into your own systems and use by your employees.
The following are not permitted:
In the event of a breach, we may terminate the contract for good cause. Claims for damages remain unaffected.
Upon delivery, you become the controller for the processing of the data within the meaning of Art. 4 (7) GDPR. Contact is made by you and in your name. You are responsible for compliance with data protection law, competition law and telecommunications law, in particular for the permissibility of promotional calls and emails, which may require prior consent, and for informing the persons concerned under Art. 14 GDPR.
If we inform you that a person or company named in your list has objected to the use of their data, you shall remove the relevant details from further use without delay.
For buyer lists ordered before 23 October 2026 and provided via the customer portal, the terms agreed at the time of their order continue to apply.
How we handle data is set out in the Privacy Policy. It forms part of these Terms.
For a contract already concluded, the version applicable at the time the contract was concluded applies.
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods and excluding the conflict of laws rules of private international law.
The exclusive place of jurisdiction for all disputes arising from this contract is the court with subject matter jurisdiction in Salzburg, Austria. We remain entitled to bring proceedings against you at your general place of jurisdiction.
Should any provision be invalid, the remainder of the contract remains valid. The invalid provision shall be replaced by a provision that comes closest to its economic purpose.
